Terms of Use

Last updated: October 29, 2026

These Terms of Use (“Terms”) govern your access to and use of Mailstar.com (the “Site”), operated by Mailstar Direct LLC (“Mailstar,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to these Terms. If you do not agree, please discontinue use of the Site. Certain features, including submission of quote requests or project inquiries, may require your affirmative acceptance of these Terms.

1. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:

  • Interfere with the operation, security, or functionality of the Site.
  • Attempt to gain unauthorized access to any portion of the Site, its servers, or related systems.
  • Introduce viruses, malware, malicious code, or other harmful materials.
  • Use automated tools, bots, or scraping technologies to extract content or data without our prior written permission.
  • Impersonate another person or entity or submit false or misleading information.
  • Use the Site in any manner that violates applicable laws or infringes the rights of others.

Mailstar reserves the right to restrict, suspend, or terminate access to the Site at any time if we reasonably believe these Terms have been violated or the Site’s security or operation is threatened.

2. Quotes, Requests + Project Information

The Site may allow you to request quotations, submit project inquiries, or provide information concerning potential printing, mailing, graphic design, or related services. Submitting a request or inquiry does not create a contractual relationship or obligate Mailstar to provide any products or services. All quotations, estimates, pricing, production schedules, turnaround times, and delivery dates are preliminary and subject to review, confirmation, and acceptance by Mailstar. No order is binding upon Mailstar unless expressly accepted in writing by an authorized representative.

Any accepted order may be subject to separate quotations, order confirmations, customer terms and conditions, or other written agreements. In the event of a conflict between these Terms and a separately executed agreement governing a customer project, the separately executed agreement shall control with respect to that project.

Mailstar reserves the right to decline any inquiry or proposed project in its discretion, subject to applicable law.

3. Customer-Submitted Materials

You may submit artwork, photographs, logos, designs, mailing lists, documents, data, or other materials (“Submitted Materials”) in connection with an inquiry or request for services.

By submitting such materials, you represent and warrant that:

  • You own or have obtained all necessary rights, licenses, permissions, and authorizations to submit the materials and permit their intended use.
  • The materials do not infringe any third party’s intellectual property, privacy, publicity, or other legal rights.
  • Your collection, disclosure, and submission of any personal information complies with applicable laws and regulations.
  • The materials do not contain malicious code or otherwise pose a security risk.

You retain ownership of your Submitted Materials. By submitting them, you grant Mailstar a limited, nonexclusive, royalty-free license to access, reproduce, process, and use the materials solely as reasonably necessary to evaluate your inquiry, prepare a quotation, communicate with you, or perform services you request and Mailstar agrees to provide.

Mailstar may use its employees and authorized service providers for these purposes, subject to applicable confidentiality and data-protection obligations.

You agree not to submit highly sensitive personal information, payment card information, medical records, or other regulated confidential information through general website forms unless Mailstar has expressly authorized the submission and provided an appropriate secure method.

Mailstar reserves the right to reject or decline to process materials that it reasonably believes violate these Terms or applicable law.

4. Intellectual Property

All content on the Site, including text, graphics, photographs, logos, trademarks, designs, software, and other materials, is owned by Mailstar or its licensors and is protected by applicable intellectual property laws.

Except as expressly permitted by law or authorized in writing by Mailstar, you may not reproduce, modify, distribute, publish, sell, license, or create derivative works from Site content.

You may view and print reasonable portions of the Site for your personal or internal business use, provided that you do not remove proprietary notices or otherwise misuse the content.

Nothing in these Terms grants you ownership of or any license to Mailstar’s trademarks, trade names, logos, or other proprietary rights.

5. Privacy and Data Security

Your use of the Site and submission of personal information are also subject to our Privacy Policy, available on the Site.

Mailstar uses reasonable administrative, technical, and physical safeguards appropriate to the information it maintains. However, no internet transmission or electronic storage system can be guaranteed to be completely secure.

You are responsible for using appropriate methods to transmit confidential or sensitive information and for following any secure-submission instructions provided by Mailstar.

Mailstar’s handling of customer mailing lists, production data, and other information supplied in connection with accepted projects may also be governed by separate customer agreements.

6. Third-Party Links and Services

The Site may contain links to third-party websites, platforms, or services for your convenience.

Mailstar does not control or endorse third-party websites and is not responsible for their content, availability, security, privacy practices, or terms of use.

Your use of third-party websites and services is at your own risk and subject to their respective terms and policies.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT, INFORMATION, AND FUNCTIONALITY PROVIDED THROUGH IT ARE MADE AVAILABLE ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAILSTAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH RESPECT TO THE SITE.

Mailstar does not warrant that the Site will operate uninterrupted or error-free, that defects will be corrected, or that the Site or its servers will be free from viruses or other harmful components.

While Mailstar strives to provide accurate and current information, we make no guarantee concerning the completeness, accuracy, reliability, or continued availability of information published on the Site.

These disclaimers apply to the Site and do not supersede any express warranties or obligations established in a separate written customer agreement.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAILSTAR AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS OPPORTUNITIES, BUSINESS INTERRUPTION, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAILSTAR’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

These limitations apply regardless of the legal theory asserted, including contract, tort, negligence, or otherwise, even if Mailstar has been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law, including liability for gross negligence, willful misconduct, or other liability that cannot lawfully be limited.

This Section governs claims relating to use of the Site and does not independently limit Mailstar’s obligations under a separately executed customer agreement.

9. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Mailstar and its members, managers, officers, employees, and agents from and against third-party claims, liabilities, damages, losses, and reasonable expenses, including attorneys’ fees, arising from:

  • Your unlawful use or misuse of the Site.
  • Your material violation of these Terms.
  • Your submission of materials that infringe third-party intellectual property, privacy, publicity, or other legal rights.
  • Your unauthorized disclosure or submission of personal or confidential information.
  • Your intentional misconduct or fraudulent activities in connection with the Site.

This indemnification obligation shall not apply to the extent a claim results from Mailstar’s own willful misconduct or violation of applicable law.

Mailstar reserves the right to participate in the defense of any covered claim through counsel of its choosing. You may not settle a claim in a manner that imposes liability or obligations on Mailstar without Mailstar’s prior written consent, which shall not be unreasonably withheld.

10. Electronic Communications

By submitting forms through the Site or communicating with Mailstar electronically, you consent to receive electronic communications relating to your inquiry, requested services, or business relationship with Mailstar.

Such communications may include quotations, project updates, order information, invoices, notices, and responses to inquiries.

You agree that electronic communications may satisfy applicable legal requirements for written communications to the extent permitted by law.

Your submission of an inquiry does not, by itself, constitute consent to receive automated marketing calls, marketing text messages, or other communications requiring separate consent under applicable law.

Promotional communications, if any, will be handled in accordance with applicable law and our Privacy Policy.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles.

Subject to applicable law, any action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in the state of New York.

Each party consents to personal jurisdiction in those courts and waives objections to venue or inconvenient forum to the extent permitted by law.

12. Changes to These Terms

Mailstar may modify these Terms from time to time.

Revised Terms will be posted on this page with an updated effective date. Unless otherwise stated, revisions will apply prospectively from their effective date.

Your continued use of the Site after revised Terms become effective constitutes acceptance of those revisions to the extent permitted by applicable law.

Material changes may require additional notice or affirmative acceptance where legally required.

13. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, or severed if necessary, without affecting the validity or enforceability of the remaining provisions.

14. No Waiver

Mailstar’s failure or delay in exercising any right or enforcing any provision of these Terms shall not constitute a waiver of that right or provision.

Any waiver must be expressly made in writing by an authorized representative of Mailstar.

15. Entire Agreement

These Terms, together with the Privacy Policy to the extent applicable, constitute the agreement between you and Mailstar concerning your use of the Site.

These Terms do not replace, amend, or supersede any separately executed agreement governing printing, direct-mail, graphic design, or other services provided by Mailstar.
